These terms ("Terms") govern your use of GiveTone ("GiveTone," "we," "us"). By creating an account or using the service, you agree to these Terms. If you do not agree, please do not use GiveTone.
1. Your account
You must be at least 18 years old to create an account. You are responsible for keeping your password secure and for any activity that happens under your account. Tell us right away if you suspect unauthorized access by emailing [email protected].
2. Acceptable use
You agree not to use GiveTone to:
- Generate content intended to defraud, deceive, or harm donors or the public
- Send unsolicited commercial email in violation of anti-spam laws (CAN-SPAM, CASL, or similar)
- Impersonate another nonprofit, person, or organization
- Reverse-engineer, scrape, or attempt to extract our AI models
- Upload content you do not have the rights to use, including logos, photos, or copyrighted writing
- Interfere with the service or other customers' use of it
3. Your content
You keep ownership of everything you upload (your brand kit, logos, photos, writing samples) and everything you generate with GiveTone (letters, appeals, reports). We do not claim ownership of your content.
You grant us a limited license to host, process, and display your content solely so we can provide the service to you. This license ends when you delete the content or close your account.
4. AI-generated content
GiveTone uses Anthropic's Claude model to generate communications from your brand kit and inputs. A few things you should know:
- AI-generated content may occasionally contain errors, inaccuracies, or outdated information. You are responsible for reviewing everything before sending it to donors.
- AI outputs are not legal, tax, or financial advice. If your communication makes specific claims about tax deductibility, program outcomes, or legal status, verify those claims independently.
- Similar inputs may produce similar outputs across customers. We do not guarantee that your generated content is unique.
5. Plans, billing, and subscriptions
AUTOMATIC RENEWAL NOTICE — PLEASE READ. Paid GiveTone plans are subscriptions that renew automatically. By starting a paid plan (including a free trial that requires a payment method), you authorize us, through our payment processor Stripe, to charge your payment method on a recurring basis until you cancel. You can cancel at any time from your billing page.
5.1 Plans and usage limits
GiveTone offers a Free plan and paid plans (currently Essentials and Growth). Each plan has a set of features and usage limits — including the number of AI generations permitted per calendar month and the size of your brand-photo library. Current plans, prices, and usage limits are published on our pricing page and are incorporated into these Terms by reference. We may adjust plan features or usage limits from time to time; material reductions to a plan you are currently on will be communicated at least 30 days in advance by email.
5.2 Free trials
Paid plans may be offered with a free trial (currently 14 days). To start a trial you must provide a valid payment method at checkout. If you do not cancel before the trial ends, your payment method will automatically be charged the then-current monthly price of the plan and your subscription will begin renewing monthly. You can cancel the trial at any time before it ends from your billing page, with no charge. One free trial per organization.
5.3 Billing, taxes, and payment method
Paid plans are billed in advance on a recurring monthly basis (annual billing may be offered in the future). Prices are shown in U.S. dollars and are exclusive of any applicable sales, use, or similar taxes, which we or our payment processor will collect where required. You are responsible for keeping a current, valid payment method on file. Payments are processed by Stripe, Inc. under Stripe's terms.
5.4 Price changes
We may change the price of a paid plan. We will give you at least 30 days' email notice before a price change takes effect. Price changes apply to your next renewal after the effective date; they never apply retroactively to a period you have already paid for. If you don't accept a price change, you can cancel before the renewal date and you will not be charged the new price.
5.5 Failed payments and past-due accounts
If a renewal charge fails, our payment processor will retry the charge over a grace period of up to 14 days. During that grace period your plan may remain partially active; after the grace period ends without successful payment, your organization will be downgraded to the Free plan and paid features will be suspended until a valid payment method is provided.
5.6 Cancellation and downgrades
You can cancel a paid plan any time from your billing page. Cancellation takes effect at the end of the current billing period — you keep paid features until then and are not charged again. After a cancellation takes effect (or after a failed- payment grace period ends), your organization is moved to the Free plan. Your content is preserved, but features and usage limits not included on Free become unavailable until you upgrade again. We do not prorate refunds for partial billing periods.
5.7 Refunds
All paid fees are non-refundable except where required by law. If you believe a charge was made in error or you experienced a material service failure, email [email protected] within 30 days of the charge and we will review your request in good faith. If we terminate your account without cause under Section 6, we will refund any unused, prepaid subscription fees for the current period. No refunds are issued for accounts terminated for cause (including violations of the acceptable-use rules in Section 2).
5.8 Disputes and chargebacks
If you have a billing concern, please contact us at [email protected] before filing a chargeback with your card issuer. Filing a chargeback without first contacting us is grounds for immediate account suspension, and we reserve the right to contest invalid chargebacks with supporting documentation.
6. Termination
You can close your account any time. We can suspend or terminate your account if you violate these Terms, if your account is inactive for a long period, or if continuing the service would expose us to legal or security risk. If we terminate your account without cause, we will refund any unused, prepaid subscription fees as described in Section 5.7. If we terminate your account for cause, no refund is issued. After termination, you may request a copy of your content by emailing [email protected] within 30 days.
7. Disclaimers
GiveTone is provided "as is." We do our best to keep the service running, accurate, and secure, but we don't guarantee it will always be available, error-free, or free of bugs. We disclaim all implied warranties to the fullest extent allowed by law, including merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of liability
To the fullest extent permitted by law, GiveTone and its owners, employees, and contractors are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the service. Our total liability for any claim arising from these Terms or your use of GiveTone is limited to the amount you paid us in the 12 months before the claim.
9. Changes to these terms
We may update these Terms occasionally. If changes are material, we'll notify account holders by email at least 30 days before they take effect. Continuing to use GiveTone after the effective date means you accept the updated Terms.
10. Governing law
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Dallas County, Texas.
